The Office of the Scottish Information Commissioner has prepared tips for requester guidance.

We will make environmental information available to any person who requests it within 20 working days (or, where the request is large and complex, within 40 working days).

There are exceptions within the regulations which may allow us to refuse to comply with your request for example, the information is not held.

Where an exception applies to the facts of your request, when we respond, we will set out the reasons for withholding the information, together with details of the mechanism for review and appeal.

Should you remain unhappy with the handling of your request and the review, you may wish to contact the Scottish Information Commissioner’s Office.

The Scottish Information Commissioner’s office provides useful guidance on the meaning of environmental information and the rules that apply.

Requests under Environmental Information (Scotland) Regulations 2004 (EIRs) allows public authorities to charge a ‘reasonable amount’ for making environmental information available. There is no upper or lower charging limits for requests, although any fee charged will not exceed the total cost of making the information available.

We do not charge for the time taken to determine whether we hold the information requested, or the time it takes to decide whether the information can be released.  However, we may recover the costs of supplying the relevant information. In the instances where charges are applied, a full breakdown of costs will be given to you and the information will not be supplied to you unless full payment has been received.

The standard charges we apply are:

• Staff time, a maximum £15 per person per hour
• Photocopying, 10p per A4 sheet / 20p per A3 sheet
• USB sticks, £1
• Postage, charged at 1st class Royal Mail rates.
